What happens if an EHC needs assessment is not agreed?

If the local authority (LA) decide that an EHCNA is not required, the decision will be clearly explained to parents no later than 6 weeks from when the original request for assessment was made.

The decision will be formally communicated in writing. The letter will include:

  • any recommended next steps or;
  • confirmation of what additional information is needed to consider a further request
  • details of who you can speak to in the SEND team
  • information about formal mediation and the right of appeal to Special Educational Needs and Disability Tribunal (SENDist)
  • contact details of other support services such as SENDIASS

Parent carers will be offered a "way forward" meeting to discuss the decision not to assess with a LA representative.
